HubSpot contacts with no subscription status or legal basis

If many contacts have no recorded subscription status, or are subscribed with no explanation of the legal basis, you may not be able to show why they receive marketing email. Review a sample of contact subscription histories with a responsible person before the next send. This page is not legal advice.

Why it matters

Privacy laws in many regions expect you to show why each contact receives marketing email. A subscription status with a source and a legal basis is how HubSpot records that evidence.

Missing status does not always mean a problem. Contacts can be in an unspecified, legacy or brand-specific state that is valid. That is why a responsible person needs to review the records rather than relying on a rule of thumb.

Bulk imports and old integrations are the usual cause. Fixing the source stops the gap from growing with every new import.

How to find it in HubSpot

  1. Open CRM > Contacts and pick a few recently imported or recently created contacts.
  2. On each contact record, open the communication subscriptions section and review the subscription history.
  3. Note each subscription type, its status, the source of the status and, if your portal records it, the legal basis and its explanation.
  4. Check where contacts entered HubSpot, such as a form, an import or an integration, so you know which source to fix.

How to fix it safely

  1. Bring the sample to a responsible person, such as your privacy or legal lead, and agree what evidence each source must record.
  2. Fix the sources: add consent options to forms, and record the legal basis and explanation when you import contacts.
  3. Do not mark contacts as subscribed without real evidence. Where evidence is missing, follow the decision your responsible person makes.
  4. Recheck a fresh sample after the change to confirm new contacts arrive with a status and an explanation.

Before you change anything: Never grant or change consent in bulk to make a report look complete. A responsible person should decide how to treat contacts without evidence. This page is not legal advice.

How Ancil checks this

Rule
MARKETING-015, MARKETING-016
What it looks for
Takes a sample of up to 10 contacts with an email address and reads their subscription status. It runs only when at least 5 contacts were sampled. MARKETING-015 flags when 50% or more of sampled contacts return no subscription status entry. MARKETING-016 flags sampled entries with a Subscribed status but no legal basis explanation. Older records and some subscription types can legitimately omit this, so both signals call for human review.
Severity
Info for both rules.
Evidence shown
The sampled email addresses, how many had status evidence, and how many requests were unavailable. For MARKETING-016, up to 50 entries with subscription name, status, legal basis, source of status and brand.
Governed fix
Not automated. Ancil never changes consent or subscription status. It reports the evidence, and your team (or an INSIDEA expert) acts on what a responsible person decides.

Frequently asked questions

Does a missing subscription status mean a contact cannot be emailed?

Not always. How HubSpot treats an unspecified status depends on your portal’s settings and the subscription type. A responsible person should decide how to handle these contacts.
